18 Conciliation Procedure. Applicable Law and Competent Court
These General Terms and Conditions shall be governed in all respects by Italian law. For any dispute concerning the interpretation, execution and/or termination of the contract between the User and IWS.com™, in the case of Direct Sale, or between the User and the Partner in the case of Intermediated Sale, the Parties acknowledge that the Judge of the place of residence or domicile of the User shall have jurisdiction, if the User qualifies as a "consumer" under the applicable laws. If, on the other hand, the User is a professional, in the case of Direct Sale the Court of Torre Annunziata, Naples, shall have jurisdiction, while in the case of Intermediated Sale the competent court shall be the Court of the Partner’s place of domicile.
19 Alternative Dispute Resolution / Online Dispute Resolution and Netcomm Joint Conciliation
Italianwineselection.com™ informs the consumer User, pursuant to Article 141-sexies of the Italian Consumer Code, that if the User has submitted a complaint to Italianwineselection.com™ but is not satisfied with the outcome or has not received a response within 30 days, the User may initiate the joint conciliation procedure established by the Netcomm Consortium. The User can find more information about this procedure, as well as the link to the relevant regulation, at the following address: http://www.consorzionetcomm.it/Spazio_Consumatori/Conciliazione-Paritetica/Conciliazione-Paritetica.kl. The application to participate must be sent to conciliazione@consorzionetcomm.it or by fax to the following number: +39 02 87181126. The conciliation procedure before the Netcomm Consortium shall be carried out pursuant to Article 49, paragraph 1, letter V of Legislative Decree No. 206 of 6 September 2005, the Italian Consumer Code. Italianwineselection.com™ also informs the consumer User that Regulation EU 524/2013 of 21 May 2013 established a European platform for the online resolution of consumer disputes, available at the following address: http://ec.europa.eu/consumers/odr/ ("ODR Platform"). Through the ODR Platform, the consumer may consult the list of ADR bodies, find the link to each of their websites and initiate an online dispute resolution procedure involving them.
